Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the theunfollower.com website (the "Service") operated by TheUnfollower ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

TheUnfollower.com is a web-based utility that allows users to analyze their Instagram data by processing the "followers and following" information contained in the data export files (JSON/HTML) provided by Instagram. The Service provides insights to help you manage your account manually.

2. Independent Service

We are an independent service and are not affiliated with, endorsed by, sponsored by, or associated with Instagram, Meta Platforms, Inc., or any of their affiliates.

3. Dependency on Instagram and Service Availability

Dependency on Instagram's Data Format: Our Service is entirely dependent on the specific content and format of the data export files provided by Instagram. We do not control how Instagram generates these files or what information they include. We reserve the right to close the Service without notice if Instagram changes their data access.

No Responsibility for Changes: We are not responsible for any changes Instagram makes to their data export contents or formats. If Instagram alters, restricts, or removes the data we rely on to provide our analysis, the Service may become inaccurate or non-functional.

Right to Close the Service: We reserve the right to close or discontinue the website at any moment without prior notice, particularly if we determine that Instagram no longer provides the necessary data files that our business model and tool are based on. We shall not be liable to you or any third party for any such termination of the Service.

Accuracy of Insights: The insights provided (e.g., "Unfollowers," "Fans," "Early Supporters") are based strictly on the data contained within your provided export. We do not guarantee the 100% accuracy of these lists. You are encouraged to verify an account's status directly on Instagram before taking any manual action. We are not liable for any "accidental" unfollows performed by the user.

4. Manual Activity & Account Safety

Manual Execution & Rate Limits: TheUnfollower provides data insights only. Any actions taken based on this data (unfollowing, following, etc.) must be performed by the user manually on the Instagram platform. We are not responsible for any "Action Blocks," account suspensions, or permanent bans resulting from the user exceeding Instagram’s manual activity limits. Users are advised to monitor their own activity frequency.

5. Subscription and Billing

Merchant of Record: Our order process is conducted by our Merchant of Record, Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. They provide all customer service inquiries and handle returns. By purchasing a Pro plan, you agree to be bound by Lemon Squeezy’s Terms of Service and Privacy Policy in addition to these Terms.

Automatic Renewal: Pro subscriptions renew automatically at the end of each billing cycle (monthly/yearly) unless canceled by the user before the renewal date.

Cancellation vs. Deletion:Cancellation: Users may cancel their subscription at any time via the billing portal provided by Lemon Squeezy. Access to Pro features will remain until the end of the current paid period.

• Account Deletion: An immediate action that purges your data and forfeits any remaining Pro subscription time without a refund.

Refund Policy: Due to the immediate delivery of digital insights and data processing services, all sales are final. No refunds will be issued for partial months of service or for changes in Instagram's data format, as stated in Section 3. As a consumer, you may have specific statutory rights under local law (such as the UK Consumer Rights Act 2015) which these terms do not intend to limit.

6. Liability for Service Termination

In the event that the Service is permanently discontinued, our total liability to any paying user shall be limited to a pro-rata refund of the current, unused portion of the user's active subscription fee. We are not liable for any loss of historical data, "snapshots," or VIP lists upon the termination of the Service.

7. Limitation of Liability

In no event shall TheUnfollower be liable for any damages arising out of the use or inability to use the Service, or for any actions taken by Instagram against your account. You use this tool at your own risk and are responsible for complying with Instagram's own Terms of Service.

8. Prohibited Conduct

You agree not to:

• Use any automated system (bots, spiders, or scrapers) to access the Service.
• Attempt to interfere with the proper working of the Service or bypass any measures we use to prevent or restrict access.
• Reverse engineer, decompile, or disassemble any aspect of the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless TheUnfollower and its owners from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including Instagram’s Terms of Service.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and TheUnfollower shall be brought exclusively in the courts of England and Wales.

Notwithstanding the above, if you are a consumer residing in the European Union or other jurisdictions with mandatory consumer protection laws, you may benefit from additional rights and may be able to bring proceedings in your local courts.
